Western Capital Respects Your Privacy!

Dear Western Capital Customer, New federal legislation requires that Western Capital notify our customers of our privacy practices. Because your e-mail address is registered with one or more of the following entities - mycollector.com, Cashspan.com, or a Western Capital affiliated portal - this notice is being sent to you.

Western Capital and its subsidiaries do not sell or share customer information submitted to these entities to marketers outside of our own family of companies. Therefore, you do not need to do anything to prevent it from being shared.

Some of you may have previously asked us not to send you newsletters or promotional materials. That choice applies only to marketing-related materials. You will continue to receive critical notices such as this one.

At Western Capital, we dedicate ourselves to revolutionizing the way small businesses manage their business debt collection needs. In that effort, we respect and protect the privacy of those who use our Web sites, products, and services. Because of our role in handling your financial transactions, new federal legislation requires us to provide this description of our information collection and sharing practices. This document, effective July 1, 2001, specifically describes how we handle your personally identifiable information and applies to financial products and services for your personal use provided by Western Capital or companies owned or controlled by Western Capital (hereafter referred to as subsidiaries). Additional information about our information practices is available in the privacy statements posted on our Web sites and in our software.

When you visit our Web sites, or acquire or use our products or services, we may ask for the following types of information:

  • General information, such as your name, address, phone, and e-mail address to fulfill your requested service and to contact you in the future.
  • Information to verify your identity, such as your mother's maiden name, in order to provide you with secure access. We may also verify your identity, or your status as a registered user, by means of a cookie. Cookies may also be used to manage your shopping cart when you purchase products on our Web sites.
  • Financial information, such as credit history obtained from a consumer reporting agency, if you apply for a loan from us; or information we request directly from you on your loan application; or bank account information we request directly from you to establish your online banking service.
  • Technical information about your computer or browser so that we may provide you with the correct product or service you request, or to format e-mail messages that best align with your computer's capabilities.

When it may be necessary to share the information you provide:

Western Capital does not share your personally identifiable information with third parties unless it is related to fulfilling the services you've asked us to perform, or as is permitted by law. The information you provide us can only be shared under limited circumstances. These include:

  • Within Western Capital and our subsidiaries
    We may share information about you, and the products and services you have purchased from us, among Western Capital and our subsidiaries, all of whom follow our privacy policies.
  • With service providers
    In some cases, we employ service providers to provide a product you order, to fulfill a service you request, or to market one of our products or services. Examples include delivering products, offering online software applications, or sending e-mails on our behalf. While this may require us to share your information, these service providers are strictly prohibited from using your information other than to act on our behalf.
  • If we transfer the servicing rights of your mortgage loan
    Mortgage loans are commonly sold. When transferring the service rights of your mortgage loan, we provide your file, including your loan application, credit report, and other loan documents, to the loan purchaser or servicer. Loan applicants are notified of this practice when applying for a loan from us.
  • For legal reasons
    In some cases we may be required to disclose certain information to comply with the law, an investigation, or a legal process, such as a court order or subpoena.
  • In case of a sale of a business
    Your information may be transferred in connection with a sale, merger, transfer, exchange, or other disposition (whether of assets, stock, or otherwise) of all or a portion of a business of Western Capital, or its subsidiaries.

Our Security Safeguards

We employ industry-standard physical, electronic, and procedural security safeguards to protect the personally identifiable information that you have provided to us from loss, misuse, or unauthorized alteration. Whenever we prompt you to transmit sensitive information, such as a credit card number, to us through our Web sites, we support encryption of your data as it is transmitted.

Former Customers

We treat information concerning our former customers the same way we treat information about our current customers.

Note: We are unable to reply personally to every response to this notice. We will make every effort to reply to specific requests.
